Terms of sale webshop

La Confiance's range of products is shipped within Belgium and on request to other European countries. Deliveries are made only according to the availability of the products, in the order of receipt of orders. The Customer accepts shipment/delivery by a third party. All transport or delivery costs in case of exceptional order quantities, formalities or taxes are entirely at the Customer's expense. Orders are dispatched twice a week. Delivery times are given as an indication only and are not binding. Delivery times may be delayed by independent or external factors. La Confiance is in no way responsible for the transport/delivery of the products, nor for any defect or possible delay in this respect. Moreover, La Confiance declines all responsibility for the delays or non-deliveries in case of force majeure or events beyond its control, which make the execution of the Agreement completely or partially impossible or more expensive, or in case of facts of third parties (such as suppliers or transporters) or in case of non-fulfilment by the Customer of its obligations. Even if the addressee refuses or fails to collect the order, La Confiance cannot be held responsible for any costs incurred for resending the product and/or for replacing spoilt, obsolete or damaged goods. Such costs are entirely the responsibility of the Customer. As the products offered are foodstuffs which can spoil or age quickly, the Customer is also not entitled to a refund on these products. Damaged goods and/or shipping costs incurred will also not be refunded in this case. If, upon receipt, the Customer finds that the package has suffered damage during transport, he must inform La Confiance immediately by e-mail. The return of the product will not be accepted. In case of breakage or damage to the packaging that would make the product unfit for use, the Customer may send an e-mail to the Customer Service Department at the following address: info@laconfiance.be by sending along with the request also the photos of the product and its packaging. The request is only possible if submitted as soon as possible and at the latest within 3 working days after receipt of the package. 

 

The articles offered on the Webshop are shipped from Belgium. Invoices are issued in euros and are subject to Belgian VAT (6%) and transport costs (21%). Payment of purchases can be made online via Bancontact. The price is payable in full in one go at the time of ordering. After verification of the payment, the customer will receive an order confirmation by e-mail. La Confiance reserves the right to suspend the shipment of orders in case of refusal of authorisation to pay by credit card by accredited organisms or in case of non-payment. In this case, the sale may be considered null and void.

 La Confiance products are in their original packaging and are considered to be fully known and accepted by the Customer. The proposed products comply with the Belgian and European legislation in force, in particular with regard to food safety. La Confiance cannot be held liable insofar as it has performed its services in accordance with the requirements of these regulations. In particular, La Confiance cannot be held responsible for product tolerance and its possible consequences. Under no circumstances can La Confiance be held liable in the event that, due to extraordinary circumstances, these products do not comply with a legal or regulatory obligation in the country where they are delivered. The Customer expressly discharges La Confiance from any liability in relation to any direct and/or indirect material damage that might result from the use of the products sold. Any complaint must be immediately addressed in writing by e-mail to Customer Service: info@laconfiance.be. If, within fifteen (15) days from the receipt of the complaint, it appears that La Confiance has not fulfilled its obligations, La Confiance will, at its own expense, make a new delivery of the products that are the subject of the complaint or, failing that, reimburse the Customer concerned the equivalent amount of the order. In any case, La Confiance will assess complaints on a case-by-case basis and in good faith and will make every effort to find the most appropriate solution for the Customer in accordance with his specifications and within the limits of these Terms and Conditions.
 
 The Webshop and all its components (including trademarks, logos, graphics, photos, videos, texts, etc.), as well as each document, methodology applied and all related computer code constitute the exclusive property of La Confiance. They are protected by intellectual property rights and may not be used without the prior written consent of La Confiance. In particular, the Customer cannot claim any rights to the computer programmes and databases used by La Confiance in the execution of the Agreement. Assuming that certain elements, documents or works of any kind are made available to the Customer by La Confiance, they remain the exclusive property of La Confiance and may not be reproduced, in any form or by any means, without the prior written consent of La Confiance.
